It gets even better.

Dear Attorney General

First problem:

A telephone company from Ct. has contacted me regarding a bill that is in my name. Apparently somebody using my name and social security number was able to get phone service in Groten Ct. and ran up a bill without paying it. After the phone company turned it over to a collection agency, I received a letter stating the debt. I called the collection agency and was advised to call the telephone company. The telephone company sent a "Fraud packet" to me. Upon reviewing the fraud packet i realized that if I complete the forms and send copies of all of my information that I am going to incur some costs and would be giving out information that could lead to a lot more fraud. I wrote a letter to them stating that i would like a document from that stating that none of the information would be used for any other purpose other than to identify me as the person "not" responsible for the debt. Also i informed them that i would charge them for my time, and for any costs that i incur.

Meanwhile i consulted the Social Security administration, their advice was not to send all of that information, sending copies of bank statements, credit card statements, utility statements, copy of drivers license, etc. would certainly lead to further fraud.

After they received the letter they called me to tell me that they would do none of the above.

I asked them if they have a signed application
They said "NO", and that all they need to start somebodies service was a name and social security number. The discussion went farther but basically ended up telling me that they can send a bill to anybody that they have a name and social security on. That person will pay it, or they will ruin their credit.

At that point i thought that they did not have grounds for collection. I thought that legally they must have a signed application or contract to pursue debt collection and report to a credit reporting agency.

to my surprise they did report the debt to the credit reporting agencies, and screwed up my credit rating.

I then sent a registered letter to them with a photo copy of my drivers license with the number covered.

they sent a letter stating that upon their investigation i still owe the debt.

My question to you is: Shouldn't they have a signed application to prove my signature?
Shouldn't they remove the information from the credit report while it is being disputed?

Now the problem gets deeper.
Second problem:

The bank that i have done business with for several years reviewed my credit profile then raised my interest rate from 11.9% to 24.9%.

I called them to ask about it. They told me that upon review of my credit profile that they decided to raise the interest rate, but would not specify what it was in my credit report that caused them to make their decision. They also stated that they sent a notice in my February statement.

I honestly do not think that i received that notice in my statement. However usually there is advertisements so i pull out the statement and throw the rest away. Also i pay by electronic transfer so i don't even send the tear off part of the statement back to them.

Is a small note along with a statement proof of delivery of adverse action notice?

After seven calls to the bank credit card dept. I finally got a copy of the notice, It said that i could write a letter to them and stop using the credit card and the interest rate would remain the same. If i did not send a letter by March 31, my rate would go to outragous.

The Notice did not have any of the information as spelled out in the "Fair Credit Reporting Act, section 615" regarding adverse action to a debtor.

Also, this seems to be predatory in nature, It is the same bank where i mortgaged my house. They did sell the mortgage, but they know whose name is on the mortgage and the amount of equity in the in the property. So it appears that if they find where somebody may be over extended on credit they raise the rate to impossible payment range, wait for a default, force a judgement, collect a part of the sale of the house.

Now, i don't want to evade my debts. But these problems are getting out of hand
as of Feb 28th I've been unemployed, It's not easy to make ends meet. Certainly makes it difficult to hire an attorney to handle this situation.

What advice can you give me?
