That definitely sounds like an open account, since the terms are that you can charge up more debt each month (as long as you pay on time.) A written contract would be a closed-ended deal, where you only borrowed at the beginning, and then paid in installments, with a specific final pay-off date. Check out the statute of limitations for your state at the link below...
