I think they have to tell you if they are recording you, I think that is a law. You know sometimes you call someplace and a recording will tell you that the call will be recorded?

I learned the hard way on the phone as well, but I wish and hope they did record me because they racked up some violations that I could sue them for. Midland called me about a month or so and I made the mistake of not hanging up, usually I will say "sorry, wrong number" when I know it is a CA, this time for some stupid reason I decided to talk, I did not say much, I played stupid by saying I never heard of them and could they send something in writing, from that point on I was abused including profanity and accusations that I am committing credit card fraud. I blew the call off until on June 26 I get a summons to appear in court, and that they are suing me for $2000. Thanks to Why Chat and the great people of this board I am fighting it. I have already sent validation letters to Midland, their attorneys and the court and disputed everything, plus added that if they continue with their suit against me I will countersuit for their FDCPA violations and will have counsel representing me in court. I hope it doesn't come to going to court, but if it does I will be there. The very first I ever heard from them was on the phone that day, they never even sent me anything ever saying that I owed them, that is, until I got the summons, which, by the way, did not even contain a copy of the complaint. I am hoping that is because they really don't have anything. It is in God's hands now and I am going to believe it will be ok.

It is funny, I am in college right now working on a paralegal degree, and I have been contemplating what to specialize in, well I have my answer, I want to know all about consumer credit and laws and then try and fight these scumsucking losers with all I got. I am so glad I found this board.
