But...doesn't the use of the word AND in the exemption clause signify that both (1) and (2) must be met, because otherwise they would have used the word OR here. This is something I learned in my paralegal courses (just started taking them this year) and this is why I read it the way I did. It says they are exempt IF and then states the requirements in (1) AND (2) not (1) OR (2).

Can you see why I am confused? Time to pull out my text books.
