You will certainly win the case filed against you if you file an answer and notice of appearance, however, to recoup your legal fees, you will need to file a countersuit for FDCPA volations.

The legal fees for defending you can not be claimed UNLESS your lawyer can PROVE they KNEW the account was time-barred.
