I had an auto repoed almost 3 years ago in the state of Florida. The car was repoed in October of 2001 and the last payment was in July of 2001. I am about ready to send out the repo deficiency letter to the collection agency, dealer, and creditor (Arcadia). I am a little concerned about being sued by Arcadia for the deficiency ($7100). They did send me the deficiency letter, but I don't think they sent the other required documents prior to resell. I know I never received a letter stating the time and place of public sell. The collection agency and the creditor has pretty much left me alone regarding the balance due, with the exception of verifying the debt to the credit bureaus and an occasional letter. Should I expect to receive copies of the required letters and if they do send them to me, what should I do (pay them)? Also, why do you say to wait 2 years from the date of repo to send the letter? Your help is very much appreciated.
