First be aware that post dating a check does not mean the bank wont process it on deposit. In our business we get alot of post dated checks and have accidentaly cashed them early and almost every one has gone through. Banks will usually even note it in their policy statements that they may cash post-dated checks early.

Anyway, the CA was just using a standard scare tactic. "Refusal to pay" is meaningless, it doesnt get you into any more trouble and is not something that ends up in a lawsuit. They already know you wont or cant pay and try to frighten you as much as possible.

Will they sue?. It depends on alot of factors, but DO NOT give them anything until you do more research here and elsewhere. Once you give them money you open up a whole new bag of worms.
