Let me give you a brief explination on how the credit card companies work. When you sign a credit card application, let's say for $5,000 and then the cc company takes this signed "Note" to the Federal Reserve Bank (which is NOT owned by the government but 2 independenty wealthy familes), and give them the credit application. The Federal Bank then gives the CC company "credit" of actually 9X the amount of the "Loan". Therefore, the bank just made $45,000 on YOUR signature!! That means that they recieved $45,000 off you! Now, congress never gave banks the right to "Create money". Only Lend money. So, in truth, they cc company never loaned you legal tender (which is described by Congress as Dollar Bill and Coins). They never loaned you money, they only gave you a Digital Number in a data bank.
So, 1st-, they can not make you pay Legal Tender for something that never existed nor charge you interest on something that never existed in the first place!!
2nd, what they have done is against the law.
3rd, they never disclosed to you that they were getting money from your signature. That in effect is a breach of contract for not giving full diclosure. Therefore, the contract is Null and Void.
4th,The company I work with actually contacts the cc companies and confronts them on the fraud that the have commited. They tell them that if they can prove that they loaned you "Legal Tender" you will agree to the payment. They of course can not prove this. Then you offer to settle for $10. They of course decline your offer. According to UCC article 2, Section 603, if you make an offer to pay off your debt obligation and it is refused, the "lender" is in default and the debt is no longer valid. The debt is discharged because the lender is in default.
I know this a lot of information and we were never taught this in schools becouse they never wanted you to learn this information.
If the credit card companies have charged off your debt, they have legaly written off your debt as a loss. They can not go back and collect. However, collection agencys, buy these debts and try to collect on them. But they have no legal right to make you pay for a debt which has NOTHING to do with them. Next time a collection agency calls you, tell them to fax a copy of the contract between you and THEM (the collection agency) and the amount that you signed for and you will pay them. OF course, they can not becouse they have no such document. Therefor, you tell them that due to "The Federal Act Protection Agency" that you want all comunication to be done in writting only and that they may no longer call you at your home or place of business. They CAN NOT CALL you anymore. IT IS AGAINST THE LAW!
