Why Chat will be back late Tues.
You use the SOL of the State where you are sued in your affirmative defense.
If you do NOT raise your SOL defense in your answer you may NOT be able to use it in Court.

That is the reason for the SOL defense part of the How To Answer A Lawsuit.

There is no "tolling" involved unless you were on active duty military for the 2 years you were out of the Country, or could not be served in your present State or former State using alternative service.
