your not stupid..hell, im 51 and do that. lol. you need your charge off date..and go back 180 days from that for sol date. get a credit report or something to prove your last date of payment b4 the account was past due or couldnt be charged on. they are counting on you to not know the law and the statute of limitations for suing. ummmm..get a credit report, it should have it on it. ask for a continuance in court to gather all your proof. while your at it, email the sec of state (tx AG--sec of state link) to see if this agency is bonded here and make sure the lawyer is licensed in texas. try bank statments..they keep them that long at the bank..also. prolly cost ya tho. how did you pay the "attempt to pay part of the debt"? that will reset the charge off dates. i know mine did. lol. they have to sue on the original contract but its up to you to prove its SOL. others may have ideas ,,ask whychat or bob.
