Ex-Wife obtained credit card

In 2000 my wife and I tried to buy something on credit and we were turned down. So my wife got both of our credit reports and found out that there was a JC Penny credit card listed on my credit report. We did not and never have had a JC Penny charge card. About 6 months later we applied for a home equity loan and the company that was handeling this said every thing looked good except the bankruptcy listed on my credit report. We then contacted my ex-wife and asked her about it and she said yes that she had opened up an old account that belonged to my self and her. Now in our divorce aggreement these accounts were all paid off and closed. Could you tell me if I have a legitiment complaint to pursue or do I not have a leg to stand on. Also what is the Statute of Limitations on something like this? Your response is greatly appreciated. William
