1) She is in violation of your settlement agreement. You need to file a complaint with the court that granted your divorce.

2) Do you or your attorney have copies of the letter(s) to JC Penney notifying them of the divorce and telling them to close the accounts? You need this to dispute the credit report tradeline with both the creditor and the credit reporting agencies.

3) The SOL depends on the state you are living in. Check Why Chat's site for the correct SOL for your state (a link can be found in the "Newcomers" post on this board.

Unfortunately, this is all too common. I have been through the same thing with my ex-husband and his re-opening of several closed joint accounts after our divorce. What I found is that most creditors will gladly re-open a closed account if it was closed in good standing...and without looking to see WHY it was closed. With some, you only need to USE the account in a transaction to automatically re-activate it. If they don't look to see why it was closed, they will come after you for payment once you dispute the debt. That is why you need copies of the letters sent to close the account as proof that you were no longer legally obligated for additional charges.
