No its not lawful, you have 30 days per the FDCPA. Some courts have ruled (improperly) that you only have as long as your state rules say you have to answer the complaint. My suggestion is dispute the debt ASAP and if this Esq. tries and moves prior to validation point that fact out to the judge and ask for a continuance until they creditor validates. for a reference see Martinez v. Law Offices David Stern its a Federal Case out of Florida that deals with a Debt Collector suing prior to validation.
