There was a post about First Resolution not being a "party in interest" according to Missouri civil procedure. Something about them being a foreign corp who misrepresents themselves as a company from Seattle, WA. If anyone could tell me where I might find it again or explain it to me as well as what to do, I would appreciate it. I believe it was JKelly who had mentioned it but am not sure. Anyhow,I got served Thursday and noticed a couple of things.... 1. There is an affidavit attached to the petition from the Province of British Columbia. 2. First Resolution's business address is listed as a P.O. Box in Seattle, WA. 3. The affidavit states an it verifies an outstanding debt and that the debt was sold to First Resolution and says that a statement of account is attached. The only attachment is a typed page showing the account number, original creditor, charge off date, principal balance and interest rate. 4. The only other information is a standard credit account agreement from FCNB Bank. 5. My name is spelled incorrectly and there is a ss# in which the first 5 digits are X's and then the it shows the last 4 digits. 6.At the end of the petition it has the standard "this communication is from a debt collector and is an attempt to collect a debt" followed by "you are encouraged to call our office in advance of the court date if you want to settle this matter" Any thoughts, suggestions. I have poured through this site looking for info. I an going to make them come up with something to prove it is my debt. Other than asking for them to show something with my signature on it, what else can I ask for? Can I request copies of the actual statements? What other paperwork do I have the right to request? Also, the summons says I have to appear to answer. Is there anything I need to file before court or can I just show up and dispute the debt? Any and all help would be appreciated.
