I went to see a lawyer today and his response to my credit card problems was chapter 13, He said because we have rental property which both have liens on them. ( my mother lives in one of them and the other we depend on for the income) that 13 would be the better way- Here is the catch- he gave us an estimate on the monthly payment we would have to make and there is no way we could do that ammount at this time.

My impression was he just wanted to file the papers and let the court make all of the decisions.

should I look for a lawyer that will actually deal with the crediters I/E negotiate settlement payments and anything else he or she can think of to keep from having to do a bankruptcy.

Does the court decide how much you can afford to pay or does it just take the ammount owed and either you can afford it or you cant ?

I know this is several questions but I need the help thank you.
