The way I read that statute is yes, and they can sue. This statute is a revision effective August 2003. What it amounts to is a legal way to avoid paying fees and registering in the state in order to conduct business here. Where their corporate office is located doesn't matter anymore. They don't even need to show up in court, just their attorney. None of the junk debt buyers are located or maintain offices in this state, yet they all sue in Missouri courts everyday. You can include this as a defense in your answer, but you need to have another defense to go with it or you won't win.
