From the above post, it seems that they probably will not sue you. Once you are past the sol, the debt will go away by itself. If you are sued and lose, then you can decide if bk is an option for you.

I know some people who have done bk and they report getting back on track in a few years. It will haunt you for ten years on your report.

The bk laws will probably stay the same at least until after the election.
