Hi there. It's been several months since I first posted on this site. I wanted to give a few praises. I had received a summons for a cc debt. Direct Merchants Bank began the lawsuit on 6/22/03. I started the process of filing my response to the summons on 7/14/03. The suit went back and forth with the requests for interrogatories and request for documents. I responded and sent my own requests. The lawyers then sent a motion for summary judgement. I again answered this request with a small but seemingly big mistake that had been made on there part. It so happened that after I had responded to the court summons that the lawyers had not sent the valadation. I blocked there efforts to receive a summary judgement by stating that they had continued the collection process without sending the proper and required valadation. The next item I received was a letter of debt valadation it was received 10/9/03. On 10/15/03 I received another letter asking for me to contact them so we could resolve the debt without undue expense. I did not respond. I am happy to report that I just received another letter on 7/5/04 requesting that the case be dismissed without prejudice. I do have to ask ONE more question. I know that if it is dismissed without prejudice, that they can reattempt to collect at a later date. Do I need to respond to this request to the court or do I need to just let it be dismissed as requested? I want to give ~many~ thanks to the help and the time that everyone gives on the board. To me and many more like me that are unaware that we have a voice when it comes to debt collectors. I want people to know that some bad debts are never intended. I tried to work with the creditor and then the lawyers before this debt ever was taken into the lawsuit form. Its time the creditors realize that they are hurting themselves by not trying to work with the consumers when it comes to repayment. Direct Merchants Bank decided to lose a 6000.00 debt rather then lower its 29.9 apr. Score one more for the Consumer........Once again good wishes to all from OK.
