You should respond, as follows,

" I will agree to a mutual dismissal without prejuidice , reserving my rights to pursue available actions against your Company for violations of the FDCPA and FCRA, including any legitimate claim for any damages ensuing from any of your proven violations.

In addition, I reserve my rights to file a complaint for violation of Court rules of civil procedure regarding your filing of a frivolous claim, and reserve my right to file any other appropriate actions and complaints with Federal and/or State authorities.

If you choose to file jointly with me for a dismissal WITH prejuidice,I will waive my rights to procceed on any and all of the above actions."
