The Chase Manhattan Bank that issued you the credit card is the original Creditor.

The FCRA states that any consumer credit debt that remains unpaid for a period exceeding 180 days is considered to be "uncollectible debt".

When the debt reaches "CHARGE-OFF" status, it is then assigned or purchased by a debt collection agency.

Under provisions of FDCPA, Phillips & Cohen is a third party debt collector, subject to all provisions of the FDCPA. They are required to willfully comply with all provisions of the FDCPA.

When Phillips & Cohen stated that they were not a debt collector, it was engaging in intention misrepresentation or fraud against you. In laymen's terms, you were lied to.

Why???

Because these money-beggar collectors only care about one thing . . . and one thing ONLY . . . HOW MUCH MONEY CAN THEY PICK FROM YOUR POCKET.

HOW MUCH MONEY CAN THEY MAKE OFF YOUR IGNORANCE AND VULNERABILITY.

I would notify my Senator, Congressman, Attorney General, BBB, and department of consumer affairs about any debt collectors that are abusing citizens, and not abiding by the law.

Keep copies of all your documentation.
