Yes, you can open a bank account with your boyfriend. They can freeze it if your name is on it, but you are making it difficult for them to find it when someone else is primary. Midland is scum. This account is probably passed the SOL.
Order a copy of your CR via snail mail. Look for the charge off date, then look for the first "30 day late"prior to that chargeoff date. That date starts the SOL.
