Creditors can't touch squat AFTER your discharge! The permanent injunction of the discharge prevents ANY kind of collection action on a discharged debt.

As for the non filing spouse in a community property state, the BK code specifically PROTECTS the non-filing spouse for the debts as long as the "community (marriage) exists. Section 524 of the BK code is very specific in this protection.

If you should divorce or anything else hapens to dissolve the marriage, THEN creditors could go after the non-filer.

Guess that last paragraph is the answer. Sounds like they could go after the surviving spouse. I printed this out, because I was surprised by the answer and I wanted to remember it. Well, crap, I don't really remember much of anything, but I try!! (grin)
