Your letter should be in the form of a motion for continuance- based on your absence from the state. Also, lawyers routinely send out letters to the court and any parties they are dealing with stating that they will be out of town from day month to day month. Validation has no value once you have moved into the court process. However, they do have to prove their case. Deny everything- or without knowledge Danger in starting discovery is that they may request it back from you.
