The date has already been changed, either by the court because of my dispute or Midland, because I can't attend on the date they changed it to, all I have to do, per instruction of the court, is write the court a letter saying that the date needs to be rescheduled. I asked the court about filing a continuance, they said that wasn't necessary, just a letter saying the date was not feasible and then the court will get a new date. I am not sending anything to Midland, the ball is in their court now to provide the validation. Put it this way, they NEVER sent me any written notification of any kind that they were trying to collect from me. The very first time I ever heard from them EVER, was a phone call where I never admitted to a debt, in fact, only asked them for something in writing because I had never heard of them, to this they responded with profanities and blatantly accused me of "credit card fraud". They hung up on me and within a month I get the summons. So I have never even had a single chance to ask for a proper validation until I got the summons. I never received anything from them like others talk about, when you have 30 days to ask for validation...that never happened at all--just the phone call and the summons.
