HI all: Couple of weeks ago, I received a letter from an attorney demanding that I pay $XXX on a credit card whch was sold to collection agency. I sent him a validation letter (also sent one to the collection agency--no word back from that collection agency). This attorney jumped on the case, did not fill in the validation form per my mail. But instead sent me---2 pages of BK 13 filing transcript which he got online and also the Schedule F (list of creditors) which I filled in when I filed Chapter 13 last year. Chapter 13 was DISMISSED---no one was paid. My question---the validation he sends me ---does proof that the account is mind (cos the Schedule F is in my handwriting) . BUT---- how can I determine that he is the correct attorney to pay??? Anyone can go online or to the courthouse and pull what he sent me as validation. So how do I get him to proof that I should pay him??? Or pay the original creditor??? Or should I just send him a letter stating that SOL has expired on this account so he cannot collect anymore??? (4 yrs for California and it has expired). ???? Help anyone????
