Violation of FDCPA

Is it true that if a debtor wants to file suit against a CA for violation of FDCPA, they must do it within one year of cause of action? If this is so, what happens if the debtor has a pending case to vacate a default judgment and the case took longer than a year to settle. Does this mean that the debtor can not file these charges even tho the case was dismissed?
