CA Filed for Continuance

Midland Credit turned us over to Small Claims. We filed a "Do not owe the debt" response. Our court date was today, 07/15. Midland Credit filed a continuance yesterday. To us this means they do not have the proof. We contacted the Magistrate Court to see if we could file a dismissal. We were told no and it was basically explained that we do not have any rights. Can they continue to file continuances until they gather their proof? We anticipate our next court date to be in August. Our date of last activity on the account was 08/00. The SOL in our state is four years. When we go for our hearing in August can we claim that the SOL has occurred, or is this not possible since they filed in May?

Any help would be greatly appreciated!
