FNANB Circuit City Lawsuit Part II

I posted my message yesterday and got some immediate response and great advice. As you may recall, I was threatened by an attorney with a lawsuit saying if I don't pay $1900 a motion would be filed today to sue me for $3500 plus court fee.

I followed your advice and basically called his bluff and made to contact with the attorney today. Finally, I got a call at home approximately 8:00PM from this so called attorney. He said after our conversation yesterday he went to his client (Circuit City) and was able to lower the settlement amount to $1200. I told him all I could do was $1000 as discussed yesterday. He puts me on hold for a minute came back and said he would take the $1000 if we can set up a check payment over the phone. I wanted to get your advice before I gave them my checking account information so I told him I would have to call him back tomorrow.

First, I want to first thank everyone for the great advice yesterday, You were right on!!!

Secondly, can I trust these guys to debit the agreed amount from my checking account seeing that we have nothing in writing. He said the letter confirmation stating the account is paid in full will be coming after the check clears.

Thirdly, I don't find paying $1000 if they will delete this record from my credit report. He told me they can not do anything regarding the credit report. Is this true? Can I make a deal and get in writing before paying the agreed amount?
