Are you still SOL? It can be based on 30days after your last payment that was not in default and never caught up (long shot). Maybe try negotiating with a tougher stance. Tell DM you have xx amount of money to spend on bills. If you can stay with that amount, you can pay your bills, them included. If they do not accept that amount and staying with the lower interest rate, you only choice would be BK and they get nothing then. Hope you have a good poker face. Get it in writing!
