Ugh, yet another credit counseling disaster story. Good that you have an attorney now. NC has a 3 year SOL for open accounts(sears) Do you know if the account was within the SOL when they filed the lawsuit. Were you legally served? Is this a default judgement? When was the last time you paid Sears BEFORE the account became deliquent? Is this an individual accout? I would say a lot depends on what they can "seize" if all of your assets are exempt, then I would say it is completely up to you. Unless you have assets that they can seize, then you have the option of paying (what you can afford) or paying nothing. A word of advice though. Protect your banking info NOW. Get your money out of the bank and pay your bills with money orders. They have a judgement against you, and they can seize your bank account without warning. That's a major mess to clean up.
