You blow me away Why Chat! Why do you think they sent it to a Collection Attorney? Of course their going to sue! BTW - If this person goes to court, then they will probably lose to a Summary Judgment. Why do people let it get that far including yourself? I had the same thing happen to me and yes I got sued by the Collection Attorney. Had I have sent the Collection Attorney request for validation then I honestly believe I would have not got sued becuase they would have been unable to validate. The same Collection Attorney sent me their dunning letter on a Discover Card account and I fired back request for validation and they dropped it like a hot potato. BTW - the Discover Card Account was well withing SOL.
