You have not entered into a verbal agreement with this firm. I would just ignore the situation completely and not deal with them. Additionally, most firms hang onto accounts for about 10 mos. before deeming it uncollectable. I would go on the internet, do a google search under "Bud Hibbs Cease and Desist" and copy the letter verbatim, obviously inserting your information. Send this to them via certified mail and you will never hear from them again. You are protected under the FDCPA laws from dealing with a 3rd party. I would then just let it fall off of your credit report. I would check your credit in Jan '05, and if it is still on there, request an investigation disputing the information and it will be removed.
