SOL in Florida is 4 years, although I have heard of judgees there that say it is 5 years. Federal law defines open accounts. Here's the thing, bk can be a last resort for both of you. If they sue, you can defend, or file bk.
I was sued very close to or maybe even passed the sol, I filed bk on the advice of my attorney. If I knew then what I know now, I would have tried to defend.
