midland credit mgt lies?

first gal that called me on old account was nice and tried to be very helpful, even getting a mortgage company to try to refi my home, but the amount would not have benefited and i believe it would have made matters even worse so didn't do it. now another of their vultures called tonite and goes thru the schmeel and i told him im unemployed and still trying to get a job so can't do anything. he says its going to go to attorney for litigation (scaretactic i know). i have talked with attorney about bankruptcy but right now can't even pay that fee yet. this guy says well you have to have $ to pay for bankruptcy and it won't help you with this anyway. i said why wouldn't it and he says once it goes to their attorney(s) for litigation its too late and bk would not help me. i said my attorney told me it was so old that yes it would be charged off. this collector says, well i'm just tellin you the truth (bs i think). i guess i really need to get a cr report to see just when these accounts did charge off. They even have one that i actually had settled with the original creditor and i already told them on that one no way was i dealin with them on it cause i settled it with aspire originally already and it was done. the first collector from mcm was trying all kinds of ways to get me to not file bk and never said to me what this guy said. what should i tell him when he calls again tomorrow? they call daily all day. i need some ammo please.
