Is this legal?

My wheels are turning here, and I was reading a response on how after a year the claim it as a tax right off and charge it off.
Now is this legal, considering they count this as a lost and claim it on their taxes, then the following year take you to court after they have wrote it off as a loss.
And get more money from you, after the IRS , ie, TAXPAYERS have eaten the bill? This cant be right. To wait a year and then write it off as a loss and get refunded back by the IRS. I think allot of these companies need audits.And if thats the case we are losing billions of americans hard working money on these companies. Any thoughts?
