In 1995 I was hit broadside by a dump truck filled to capacity with gravel. The driver ran a red light and was going 45 mph when he hit me. (He "accidentially" hit the horn instead of the brake was his defense!) He did get a ticket and had to pay a hefty fine, but was never sued by the insurance company or by me. It makes me wonder if the person sueing already tried sueing the insurance company and lost or was dismissed for a technicality or this is an attempt to double dip the system or didn't get the insurance information at the scene of the accident. There could be a lot of reasons he/she is going after your friend instead of the insurance company that could impact the outcome of a court case and any liabilty that your friend has. Your friend should contact and hire an attorney. It may cost money that your friend doesn't have, but an attorney could save much more than just money in the long run.
