PA's SOL is only 4 years and if 6/2000 was the last payment, the SOL runs out on Saturday 7/31 !!! Although, with the lawsuit already filed, she may have to use this next line of defense. If she was under age when she got the card and has NOT used it since she turned 18, then the she can get out of it even easier - minors cannot enter into contracts, the whole thing could be voided. All she needs is proof that she was underage when the account was opened. And, finally, collection calls on a cell phone are ILLEGAL, a violation of the FDCPA. The collector's tactics to GET her number were also a vioaltion of the law - using deception is NOT allowed in the FDCPA ! Has she answered the summons yet ?
