JP Morgan Chase & Co. Sued for Overtime Violations at Call Centers


July 29, 2004 — HOUSTON, TX - Tens of thousands of current and former JPMorgan Chase & Co. call center employees in at least 11 states may be affected by a lawsuit alleging that the global financial services firm violated Fair Labor Standards Act ("FLSA") overtime regulations.

Filed in federal court in Houston, the complaint alleges that for at least the past three years non-exempt employees at JPMorgan call centers throughout the nation were expected to perform numerous unpaid tasks before and after their paid shifts so that their time taking customer calls could be maximized.

The lawsuit was brought by Jennifer Fouyolle, who was employed as a non- exempt hourly call center employee in Houston, Texas from approximately September 1999 through approximately June 2002.

Plaintiffs' counsel, J. Derek Braziel, of Edwards & George, LLP in Dallas, stated that non-exempt call center workers have spent significant amounts of time working without pay for JPMorgan's benefit.

Plaintiffs' counsel Richard J. Burch, of Bruckner Burch, PLLC in Houston, stated that the plaintiffs will seek to have their case proceed as a collective action lawsuit and seek overtime pay, liquidated damages, attorneys' fees and other relief for hourly compensated workers employed during the three years immediately preceding the filing of the lawsuit.

JPMorgan operates or has operated call centers in Texas (Houston, San Antonio, Arlington and Dallas); Pennsylvania (Fort Washington); Arizona (Tempe and Phoenix); Missouri (Kansas City); Massachusetts (Boston); Ohio (Columbus); Colorado (Littleton); Florida (Tampa); Delaware (Newark); Louisiana (Monroe); and Illinois (Chicago). This case does not involve current and former Chase call center employees in the State of New York.

The case is on file in the U.S. District Court for the Southern District of Texas, Houston Division (H 04-2219).
