If this is all the creditor/CA has to bring to court, you should be able to toast them easily. They would of course have the name of the card, e.g. "Capital One Suckerpunch VISA" on the application, statements, etc that they should have brought if they were hoping to win.

VISA and Mastercard are different companies, but they like to dance right at the edge of anti-trust violations. It's similar to the situation with Coke and Pepsi. Ever notice that Coke and Pepsi products are never offered at sale price at the same time in the same store? That's because they've agreed not to compete this way. It's as if they've "fixed" the "price"...
