IF your house is in your husband's name only, you would not be able to reaffirm on the house since your name is not on the mortage. However, you would be able to count the house payment as part of your disposable income....you'd probably have to list it as rent, i.e. living expenses.

You definitely need to talk with a VERY reputable bankruptcy lawyer who can advise you on your son's trust fund. I really don't think that would present a problem. Since you would be considered head of household your car would most likely be emempt.

Since you are already 5 months behind on your CC payment, it will be charged off at the end of 180 days. You might want to consider making a decision before this happens. Once it is charged off, the FUN begins with the CA's.
