First of all, laws regarding Powers of Attorney differ from state to state. Some states require to ONLY have two (non-related) witnesse while other states require the POA to be notarized as well as have witnesses. You really need to consult with an attorney regarding your particular situation. Each situation is different.

Even though banks are regulated under federal law, some states have their own banking regulations as well. SOME banks have their own corporate 'policy' which is not necessarily the law but is designed for their convenience and business practice.

I still think your best bet would be to FIRST talk with the bank manager. He/She could tell you IF your would have access to your husband's account. If not, he/she can advise you on how to change the account to where you could have access to it. IF he/she doesn't have the answer, then consult an attorney.
