Was this a federal student loan? Like a Perkins, Direct or Stafford loan? You need to understand that there is no SOL for government-guaranteed student loans. Not only that, but they don't need to sue and get a judgment before garnishing paychecks or bank accounts.

There are MANY ways to get student loans out of default without going through the CA. It would be in your best interest to work directly with the Department of Education to get your loan out of default. http://www.ed.gov/offices/OSFAP/DCS/index.html

Don't count on your husband's name being primary on the bank account as a shield against the Federal government. It might work with a CA, but I wouldn't count on it working with Uncle Sam.
