You are not going to find "caselaw" on the subject in Fl. or anywhere else, since it is NOT a subject for appeal.

If a lower Court judge has made an obvious legal mistake in applying State or applicable Federal laws in any case, the REVIEW is done by a system that does NOT publish their error.

This is why I have in my "How To Answer A Lawsuit" all the complete legal citations to be used, and why I tell people who are pro se to make SURE their answer is ENTERED in their case file, even in Small Claims Court, so that any Judge who may wish to favor a CA plaintif is on notice that his/her actions will be subject to review by their peers.
