Obviously they can sue because you have been served a Summons. Now you have to decide whether to fight or settle. I think the FDCPA regarding disputes only applies to Collection Agencies. Here in TX, to be able to sue, an original creditor just needs to notify you in writing that you owe the debt and how much you owe. If they've done this then it's my understanding that they can move forward with a lawsuit. But if they move forward and sue anyway who's going to care? You'll never get a dismissal based on this. Get a lawyer. Oh, and you mispelled Sheriff (it's written on the side of their car.)
