I am trying to point people onto what law to focus on if you want to keep Hubris Shafritz from racking you up with a 5 year SoL case in FL, if it exists.

Anyone who has the case law on the legal definition of a written contract for the purpose of SoL for each state's legal system needs to provide it on this board for the benefit of others, since that is what is critical to know if your vulnerability to a lawsuit ends at the open account SoL or the written contract SoL on a breached credit card agreement.

Also, they typically use an additional cause of action of unjust enrichment when they sue. But since that is based on a quasi-contract, a contract-in-law, not a contract-in-fact, that falls under the open account SoL, so when you see it don't worry. The big problem is if the complaint asserts a written contract cause of action.
