Garnishment is different than "Freezing". Garnishment can only occur if you have a valid judgment against you or if you have a contractual arrangement with the bank that allows them to take money from your account if you default on an account with them.

IN Texas, creditors are allowed to "freeze the accounts" before judgment. Freezing means that the bank puts a stay on the account. You can't use the account but the money is still in the account. THe creditor can't get it but neither can you. This is usually done prior to a court hearing to prevent you from disposing of your cash. It can happen without notice in Texas. Once they get a judgment though, they can then garnish (take the money out of )your account without any notice at all. You will have to file a motion to get it back if you can prove that some funds in your account are exempt.
