another sol question

Ok, all of the information has been great!

If my cbr shows 9/00 as the first 30 day late....does that mean I am passed sol of 4 years if the last payment was the first or so of August? Am I safe to send the sol letter. They are threatening to sue and said in a message today that the paperwork was being sent ( I assume it would be to file a lawsuit. I don't know if I can hold them off until Sept. or not. I'd like to send the SOL letter before they have a chance to file.
