They are lying to you. First of all, exactly how old is this account. When did you last pay the original creditor before the account became deliquent. I AM NOT TALKING ABOUT PAYING CAs, it doesn't matter. WHEN DID YOU LAST PAY THE ORIGINAL CREDITOR. You are in Texas which is a debtor freiendly state. They can not touch your house, and they can not garnish your wages. PROTECT your banking info. In Texas, your bank account is the prime target. So, keep minimal cash in the bank. It really is NOT likely that they will sue. It is quite normal for CAs to threaten a law suit. The percentages are low though. It will cost them money to sue you. It will cost them filing fees, and attorney fees in your state. So, as long as you protect your banking info, there really isn't much they can take.

You might try calling the OC and see if they still own the account. That would make a big difference.
