Welcome to the Late-in-Life Student Loan Payer's Association! And congratulations for having your priorities straight....I made the same choices as you did for a brief period, and I don't regret it. The immediate needs of our children should come first over any debt.

Is the SL straggler also a Federally-backed loan?

JKelly sent you a good link. If you consolidated your loans, then the Dept of Ed may have already added the other loan to the consolidated account, which might explain the "paid" notation. Adding to the confusion is the fact that there are three creditors to every loan: The lender, the guarantor, and Uncle Sam. There may be no record of the loan because it's been transferred to either the guarantor or to the Dept of Ed.

But, say for the sake of argument that the loan was somehow missed. If that is the case, for a limited time (I forget the exact time limit) you can add additional loans to your consolidated loan. It should only take a few weeks to do that, and once you have applied to have the loan consolidated, you can add that information to your answer.

The Dept of Ed site (once you get a PIN to logon) allows you to search for all government-backed loans in your name and their current status.
Try to get the account numbers, amounts and current status of each loan from the Dept of Ed directly.

Once you have that information, you can answer the lawsuit with definitive proof of payment, or you can take steps to add the straggler to your current loan. If you can't add it to the currently consolidated account, you should be able to consolidate it on its own since it's in default.
