I sent them a settlement right after the sheriff pounded on door in late april. I got no intitial response. I then filed my answer in June and at the end of June I got a letter in mail that said they would accept the offer. But it was just a generic two line letter saying I would need to pay xxx dollars by a week later. It didnt reiterate any of the demands I made with it. I specifically in letter stated that the debt was never validated so I might be clear there.
When you say Sherman will fold, what do you mean? Once I show they will dismiss? I know the chances of them having any backup whatsoever is small. Especially since I believe this card was first iniated over the internet and not me applying by hand.
I just would like to know what to state to judge when he asks me point blank if this debt is mine. Also what is my end goal in this? To have the case dismissed? That is the only thing I can hope for here I guess, but if a judgement goes against me BK here we come, and I dont mean Burger King.
